Ces Conditions d'Utilisation régissent votre accès à la plateforme Mekavo, exploitée par USK DIGITAL LTD (opérant sous le nom « Mekavo »), enregistrée en Angleterre et au Pays de Galles (N° de société 16477044). Ces Conditions sont conformes à la législation de la République Algérienne Démocratique et Populaire relative au commerce électronique et à la Loi n°09-03 du 25 février 2009 relative à la protection du consommateur.

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Acceptance of Terms

By accessing or using Mekavo, you confirm that you are at least 18 years old, have the authority to bind the business entity you represent, and agree to comply with these Terms and all applicable laws.

2. Account Terms

• You must provide accurate, complete, and current registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorised access to your account
• One person or business may not maintain more than one free trial account
• You are responsible for all activity that occurs under your account

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorised access to the Service or its related systems
• Upload malicious code, viruses, or any harmful software
• Use the Service to send unsolicited bulk messages (spam)
• Reverse-engineer, decompile, or disassemble any part of the Service
• Resell, sublicence, or redistribute the Service without our written consent
• Use the Service in a way that could harm, disable, or impair the platform

We reserve the right to suspend or terminate accounts that violate these terms.

4. Your Data

You retain ownership of all data you upload to the Service ("Your Data"). By using Mekavo, you grant us a limited licence to store, process, and display Your Data solely for the purpose of providing the Service.

You are responsible for ensuring that you have the right to upload and process any personal data belonging to your customers. You act as the data controller for your customers' data, and Mekavo acts as the data processor. See our Privacy Policy for details.

We will not access, use, or share Your Data except as necessary to provide the Service, comply with the law, or as otherwise described in our Privacy Policy.

5. Payment Terms

6. Cancellation and Termination

• You may cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of your current billing period — you retain access until then
• Upon cancellation, your data will be retained for 90 days, after which it will be permanently deleted
• You may request immediate data deletion by contacting us
• We may terminate your account if you breach these Terms, with or without notice

7. Intellectual Property

The Mekavo name, logo, software, design, and all related content are the intellectual property of USK DIGITAL LTD. These Terms do not grant you any rights to our trademarks, branding, or proprietary technology.

You may not copy, modify, distribute, or create derivative works from any part of the Service without our prior written consent.

8. Service Availability

We aim to provide 99.9% uptime but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will notify you in advance where possible)
• Emergency maintenance or security patches
• Circumstances beyond our reasonable control (force majeure)

We are not liable for any loss or damage caused by service downtime.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the Service will be error-free, secure, or meet your specific requirements
• Our total liability for any claim arising from or related to the Service shall not exceed the total fees paid by you in the 12 months preceding the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunity

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

10. Indemnification

You agree to indemnify and hold harmless USK DIGITAL LTD, its officers, directors, and employees from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through a notice on the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

Ces Conditions sont régies par les lois d'Angleterre et du Pays de Galles. Nous respectons vos droits en vertu de la Loi n°09-03 de protection du consommateur de la République Algérienne Démocratique et Populaire. Vous pouvez contacter la Direction Générale du Contrôle Économique et de la Répression des Fraudes (DGCERF).

If you are a consumer in the European Union, you may also have the right to submit a dispute to the EU Online Dispute Resolution (ODR) platform.
