These Terms of Use ("Terms") govern your access to and use of the Mekavo vehicle owner and fleet management portal ("Service"), operated by USK DIGITAL LTD ("we", "us", "our").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not create an account.

1. Acceptance of Terms

By registering for an account, accessing or using the Service, you confirm that you have read, understood and agree to these Terms and our Privacy Policy.

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notification. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Service Description

Mekavo provides a digital platform for vehicle owners and fleet operators to:

• Store and manage vehicle records, service history and documents
• Receive reminders for MOT, insurance, tax, services and custom dates
• Look up official vehicle data (where available in your country)
• Complete and store vehicle inspection checklists
• Report and track vehicle defects
• Track fuel consumption and mileage
• Manage fleets with teams, drivers and vehicle assignments
• Connect with garages that service your vehicles

Feature availability may vary by country and subscription tier.

3. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering, you confirm that:

• You are at least 18 years old
• The information you provide is accurate and complete
• You will keep your account information up to date
• You have the legal authority to agree to these Terms

4. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must:

• Choose a strong password and not share it with anyone
• Notify us immediately if you suspect unauthorised access to your account
• Provide accurate personal and contact information
• Maintain only one personal account per person

We may suspend or terminate accounts that violate these Terms or are used fraudulently.

5. Vehicle Data

Where available, the Service allows you to look up official vehicle data from third-party providers. You acknowledge that:

• Vehicle data is provided by third-party sources and we do not guarantee its accuracy or completeness
• Data availability varies by country and vehicle type
• Vehicle lookups may be limited by your subscription tier
• You must not use vehicle data for purposes that violate applicable law

You are responsible for verifying the accuracy of any vehicle information stored in your account.

6. Inspections & Records

The Service provides digital inspection checklists and record-keeping tools. You understand that:

• Inspections completed through the Service are for your own record-keeping purposes
• The Service does not replace mandatory statutory inspections or examinations required by law
• You remain solely responsible for ensuring your vehicles comply with all applicable regulations
• Inspection records are stored according to the retention periods set by your organisation or the applicable legal requirements in your country

We do not certify, validate or endorse any inspection completed through the Service. A digital inspection record does not constitute a legal certificate of roadworthiness.

7. Fleets & Organisations

If you create or join a fleet organisation, you acknowledge that:

• Organisation owners and managers can view inspection records, vehicle data and defect reports for vehicles within the organisation
• Organisation owners are responsible for managing member access and permissions
• Data you create within an organisation (inspections, defects, vehicle records) is accessible to authorised members of that organisation
• If you leave an organisation, records you created within it may be retained by the organisation
• Organisation owners are responsible for ensuring their use of the Service complies with applicable employment and data protection laws

8. Subscriptions & Payments

The Service offers both free and paid features:

• Free tier — service records, documents, fuel tracker, email reminders, basic inspections
• VIP (individual) — SMS reminders, vehicle lookups, priority features. Billed annually via Stripe.
• Fleet plans — per-vehicle pricing for business and public sector organisations. Billed monthly via Stripe.

Paid subscriptions renew automatically unless cancelled before the renewal date. You may manage or cancel your subscription at any time through the billing portal. Refunds are handled in accordance with our Refund Policy.

We reserve the right to change pricing with 30 days' notice. Price changes do not affect the current billing period.

9. Data & Privacy

We collect, process and store your personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing.

You may request a copy of your data, request corrections, or request deletion of your account at any time. See our Privacy Policy for full details on your rights.

10. Intellectual Property

The Service, including its design, software, content, logos and trademarks, is owned by USK DIGITAL LTD and protected by applicable intellectual property laws. You may not copy, modify, distribute or reverse-engineer any part of the Service.

Content you create (inspection records, vehicle notes, photos) remains yours. By uploading it to the Service, you grant us a limited licence to store, process and display it within the Service as necessary to provide the features you use.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" without warranties of any kind, express or implied
• We are not liable for any missed reminders, notifications or alerts, regardless of the cause
• We are not liable for the accuracy of third-party vehicle data
• We are not liable for any consequences arising from inspection records or defect reports
• Our total liability to you shall not exceed the amount you have paid us in the 12 months preceding the claim

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Termination

You may delete your account at any time from your account settings. Upon deletion:

• Your personal data will be deleted in accordance with our Privacy Policy
• Vehicle records, inspection data and documents will be permanently removed
• Active subscriptions will be cancelled (no refund for the current period)
• Data shared with organisations you belonged to may be retained by those organisations

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.

13. Applicable Law

These Terms are governed by the laws of England and Wales, without prejudice to any mandatory consumer protection provisions of your country of residence under EU law. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
